Plus de dix ans après les faits, la Cour d’appel de Paris vient de rendre une décision dont il est bien difficile de dire si elle est favorable – ou non – aux journalistes financiers, dont la marge de manœuvre avait été sérieusement restreinte par la commission des sanctions de l’AMF en 2018, mais qui avaient reçu un soutien appréciable de la part de la Cour de Justice de l’Union Européenne (CJUE) en 2022 (1). Reste à savoir si le journaliste du Daily Mail (aujourd’hui retraité) aura l’envie – et les moyens – de poursuivre le combat juridique devant la Cour de cassation, plus pour une question de principe que pour un enjeu financier désormais limité à 10.000 euros ?
