Paris, le 30 avril 2015 – JeantetAssociés a conseillé le SYNHORCAT, la CPIH et la FAGIHT dans le cadre de leur plainte contre les clauses anticoncurrentielles imposées par Booking.com dans le secteur de la réservation hôtelière en ligne.

Depuis de nombreuses années, Booking.com, plateforme de réservations hôtelières, imposait des clauses dans leurs contrats avec les hôteliers, exigeant d’eux de bénéficier de tarifs (parité tarifaire), de conditions (petits-déjeuners offerts, etc.) et de disponibilités au moins aussi favorables que ceux proposés sur les plateformes concurrentes ainsi que sur l’ensemble des autres canaux de distribution de l’hôtel.
Booking.com a, suite à cette plainte, proposé à l’Autorité de la concurrence un certain nombre d’engagements pour mettre fin à la procédure dirigée contre elle.

Le 21 avril 2015, l’Autorité de la concurrence a accepté de Booking.com, des engagements visant notamment à supprimer la parité tarifaire et la parité de conditions à l’égard des autres plateformes de réservation en ligne mais aussi des canaux hors ligne des hôtels (e-mails, téléphone, réception, etc.). Booking.com s’est également engagée à supprimer toute obligation de parité de disponibilités, tant à l’égard d’autres plateformes de réservation en ligne que des canaux hors ligne et en ligne des hôtels.
 
Booking.com s’est engagée à mettre en œuvre ces dispositions pour une durée de 5 ans. Un bilan d’étape, contradictoire avec les parties saisissantes, est prévu au plus tard le 1er janvier 2017,  pour vérifier si les engagements ont bien permis de dynamiser la concurrence de manière significative, de développer la concurrence entre plateformes, de réduire le niveau des commissions et d’élargir l’offre concurrentielle.
 
JeantetAssociés conseille également les syndicats hôteliers dans le cadre de leur action auprès du Ministre chargé de l’Économie devant le Tribunal de Commerce, visant notamment à obtenir la nullité de ces clauses (parité tarifaire, de conditions et de disponibilités).
