Aujourd’hui, jeudi 3 mai 2011, s’est tenu un colloque sur les enseignements en matière de contrôle interne de la décision de la Commissions des Sanctions de l’Autorité de Contrôle Prudentiel du 16 décembre 2011 à l’encontre de l’établissement A. Ce rendez-vous réunissait des professionnels de nombreux établissements bancaires appartenant tant à la direction générale, qu’à la direction juridique, à la direction de la conformité, ou à la direction des risques autour de quatre intervenants :
– Maître Martine Samuelian, Associée responsable du Pôle Institutions et Services Financiers du cabinet JeantetAssociés AARPI, dont l’intervention rappelait « les principes et règles de procédure lors et suite à une mission de contrôle sur place de l’ACP » ;
– Frédéric Visnovsky, Secrétaire général adjoint au Secrétariat Général de l’Autorité de Contrôle Prudentiel, dont l’intervention détaillait « les caractéristiques du dispositif de contrôle interne dédiées aux opérations de marché » ;
– Bruno Martin-Laprade, Président de la Commission des Sanctions de l’Autorité de Contrôle Prudentiel, dont l’intervention précisait « les orientations et attentes de la Commission des Sanctions de l’ACP » ;
– Anne-Dominique Merville, Directrice du Master Droit Pénal Financier et Maître de conférences à l’Université de Cergy Pontoise, dont l’intervention analysait « la décision QPC 2011-200 du 2 décembre 2011 et son interprétation ».
Lors de son propos introductif, Maître Martine Samuelian a rappelé que « la décision de la Commission des Sanctions de l’Autorité de Contrôle Prudentiel du 16 décembre 2011 porte de très nombreux enseignements sur les manquements de l’Etablissement concerné à son obligation de mettre en œuvre un contrôle interne adéquat de l’organisation de sa salle des marchés et des opérations qui y sont exécutées. Elle se démarque par l’exceptionnel volume (28 pages) et le nombre impressionnant de griefs examinés (61 griefs). L’abondance des griefs notifiés a permis à l’autorité de jugement d’aborder de nombreuses problématiques applicables aux établissements de crédit, liées principalement au respect des dispositions du Règlement CRBF n°97-02 modifié du 21 février 1997 relatif au contrôle interne des établissements de crédit et des entreprises d’investissement (contrôle permanent de premier et de second niveau, contrôle périodique, suivi des recommandations des divers organes de contrôle, mesure des risques de marché, surveillance et la maitrise des risques opérationnels, dispositif des limites, formalisation des procédures, etc.) »
