L’intervention de Loraine Donnedieu de Vabres-Tranié : « Loyauté dans l’administration de la preuve » a lieu l’après-midi du samedi 31 mars (1h30-18h30), sous la présidence de M. Marc Guillaume, Secrétaire Général du Conseil Constitutionnel.
Les concepts de loyauté et d’impartialité qui relevaient de la morale ou de l’éthique font désormais partie du droit positif sous l’impulsion moins du législateur français que des juges communautaires – Cour de justice de l’Union européenne et Cour européenne des droits de l’homme – et des juges français – Cour de cassation et Conseil d’État.
Les applications de ces concepts concernent l’entier domaine de la pratique du droit des affaires : impartialité et indépendance des juges, des magistrats et des arbitres, statut des formations de « jugement » des autorités administratives indépendantes, devoir de loyauté dans la conduite du procès, dans l’administration de la preuve, dans la négociation et l’exécution des contrats, dans la gestion des sociétés commerciales, indépendance et loyauté dans la conduite des procédures collectives.
L’association Droit et Commerce ambitionne d’approfondir ces concepts, de dégager leurs virtualités et de préciser leurs applications concrètes.
