Catherine Cathiard, Avocate à la Cour et Francis Collin, Associé, animent un petit déjeuner mercredi 7 mars 2012 de 8h30 à 10h30 sur le thème : «Echanges autour des aspects sociaux de la Société Européenne : participation aux réflexions de la Commission Européenne en vue d’une éventuelle modification de la directive 2001/86/CE»La Commission Européenne travaille actuellement sur l’application de la Directive 2001/86/CE du 8 octobre 2001 relative à l’implication des travailleurs dans la Société Européenne avec, pour objectif, de présenter, en 2012, ses conclusions quant à d’éventuelles propositions de révision du texte.
Cette réflexion de la Commission Européenne fait suite à une consultation des partenaires sociaux lancée dès juillet 2011. Si les partenaires sociaux décident de ne pas entamer de négociations suite à cette phase de consultation, ce qui semble être le cas, les conclusions de la Commission Européenne pourraient être présentées au cours du troisième trimestre 2012.
Les principaux « problèmes » auxquels cette initiative vise à remédier sont « en particulier les règles relatives à la participation des travailleurs », « le champ d’application du principe “avant-après”», « les doubles exigences lorsqu’un comité d’entreprise européen existe déjà ». La question est de savoir « dans quelle mesure une simplification de ces mécanismes pourrait se justifier ».
JeantetAssociés se propose d’intervenir au coeur de ce débat dans le cadre de sa coopération régulière sur ces questions avec les équipes la Commission européenne. Afin d’être une force de propositions adaptées aux attentes des entreprises, nous pensons qu’il est important de partager avec vous nos réflexions relatives au fonctionnement et à l’avenir de la Société Européenne.
A cette fin, nous souhaitons constituer un groupe de travail sur le volet social de la Société Européenne qui aurait pour mission de partager nos expériences et de débattre sur les évolutions nécessaires de la Directive 2001/86/CE ; les conclusions de nos échanges pourraient utilement être communiquées à la Commission Européenne.
